California overtime calculator: daily overtime, double time and the 7th day

California pays overtime by the day as well as by the week. A weekly-only calculator underpays a California week with long days. Turn on the daily, double-time and 7th-day rules in Overtime & rounding (Hoursprig Pro) and the time card applies all of them without counting any hour twice.

California's general overtime rule (DIR)
  • 1.5× for hours over 8 in a workday, up to 12, and for hours over 40 in the workweek
  • 2× for hours over 12 in a workday
  • 7th consecutive day in a workweek: 1.5× for the first 8 hours, 2× after 8
  • Many exemptions and exceptions exist (see the DIR page)

What the Labor Commissioner says

"One and one-half times the employee's regular rate of pay for all hours worked in excess of eight hours up to and including 12 hours in any workday, and for the first eight hours worked on the seventh consecutive day of work in a workweek; and double the employee's regular rate of pay for all hours worked in excess of 12 hours in any workday and for all hours worked in excess of eight on the seventh consecutive day of work in a workweek."

Same 64:00 hours, $40.00 more with the California rules, from Monday's 13th hour and Saturday (the 7th consecutive day). Friday's hours are all overtime because the regular hours already reached 40 for the week; hours paid as daily overtime are not counted again toward the 40 (no pyramiding).

How to set it up

  1. Open Overtime & rounding; switch on daily overtime after 8 hours, double time after 12, and the 7th-day rule (Pro).
  2. Set Workweek starts to your workweek's first day: the 7th-day rule counts consecutive days inside one workweek.
  3. Enter the times and breaks; the totals split into regular, overtime and double time per day.

Honest limits

Hoursprig applies the general rule above with your settings. It does not handle alternative workweek schedules, exempt employees, meal/rest-break premium pay, or regular-rate adjustments for bonuses and commissions. The weekly 40-hour rule is free; the daily, double-time and 7th-day rules are Pro ($15 once).

Questions

How is overtime calculated in California?

Under the general rule, 1.5× after 8 hours in a workday or 40 in a workweek, 2× after 12 hours in a workday, and on the 7th consecutive workday of the workweek 1.5× for the first 8 hours and 2× after that (California DIR overtime FAQ).

Does daily overtime count toward the 40-hour week?

Hours already paid as daily overtime are not paid a second time as weekly overtime. Hoursprig counts only the remaining regular hours toward the 40.

Is double time after 12 hours or 10?

Under the general rule, after 12 hours in a workday, and after 8 hours on the 7th consecutive day of the workweek.

Is the California mode free?

The weekly overtime rule is free. Daily overtime, double time and the 7th-day rule are part of Hoursprig Pro, $15 once.

Is this legal advice?

No. Exemptions, alternative workweeks and special industries change the rules; check the DIR page or an employment lawyer.
